A. Customer information on the conclusion of distance contracts

The following information is intended to fulfil our legal obligation to provide information in the case of distance contracts and electronic commerce.

All information will be received at the latest upon delivery of the goods in text form. You can also print this information or save it to your hard drive.

2. Conclusion of the contract

For orders made via the online form on our website, after completing the electronic order form (see B 1 below), you make a binding offer to conclude a purchase contract by clicking on the "Order subject to payment" button. Before submitting the order, the customer can change and view the data at any time.

The Seller will immediately confirm receipt of the Customer's order by email. The order confirmation is listed in the automatic order confirmation and it can be printed using the "Print" function.

The purchase contract does not already come into being with this order confirmation in the case of payment by prepayment/transfer, direct debit and cash payment at the time of collection, but only with the dispatch of a separate email with an order confirmation or the delivery of the goods. In the event of payment by prepayment/transfer, the Seller is entitled to accept the contract offer contained in the order within 2 working days. It is tantamount to acceptance if the seller delivers the ordered goods within this period.

In case of payment by credit card or PayPal, the contract is already concluded with payment instruction by the customer. The condition for an effective conclusion of the contract is always that the order process is completed with the sending of the order.

The text of the contract is stored by the seller and sent to the customer by email together with the legally incorporated GTC after conclusion of the contract.

3. Delivery and delivery reservation

(1) The delivery period for deliveries within Germany is indicated on the respective offer side. The start of the delivery period is determined (depending on the chosen payment method) according to paragraphs 2 to 4.

(2) In case of payment by prepayment/bank transfer, credit card or PayPal, the delivery period begins one day after the payment order has been issued. For all other payment methods, the period begins one day after the order.

3. If the beginning of the time limit or the end of the period falls on a Saturday, Sunday or a public holiday, the beginning or end of the period shall be postponed to the following working day.

(4) Shipping is made exclusively to the specified countries as well as to the VERSANDINFORMATION / LIEFERBESCHRÄNKUNGEN [LINK] specified restrictions or modes of delivery.

(5) The delivery is subject to proper self-delivery.

4. Purchase price and shipping costs

(1) The prices quoted are total prices in euros and include the statutory value added tax. Temporary special offers or discounts are shown as such in the context of the presentation of the individual goods on our website.

(2) The additional shipping costs incurred during shipping are included in the overview shipping costs / delivery restrictions [LINK]. Costs for packaging are already included in the shipping costs.

(3) Otherwise, the customer does not incur any additional costs when ordering by using the means of distance communication.

5. Payment arrangements and costs of means of payment

(1) The customer can make the payment by prepayment/bank transfer, credit card, PayPal, direct debit or cash upon collection.

(2) The costs of the selected means of payment, if any, are displayed in the virtual shopping cart and in the "Payment options" overview.

(3) If payment is made by prepayment/bank transfer, credit card, direct debit or cash payment upon collection, the customer will not be charged any additional costs.

(4) Payment by PayPal incurs costs of 2.5% of the invoice amount.

6. Right of withdrawal for consumers as well as model withdrawal form

Consumers – i.e. any natural person who concludes a legal transaction for purposes which cannot be attributed primarily to his commercial or self-employed professional activity – may revoke their declaration of contract in the case of contracts for consideration under the Contradiction conditions set out here.
7. Warranty Conditions

The customer is entitled to a statutory warranty right, which is modified in accordance with Sections 8, 9 of the General Terms and Conditions.

8. Note on the Battery Act

Batteries are included in the scope of delivery of many devices. Batteries or batteries can also be fixed in the devices themselves. In connection with the distribution of these batteries or batteries, or in connection with the supply of devices containing batteries or accumulables, we, as a distributor, are obliged under the Battery Act to inform our customers of:

Batteries and batteries do not belong in household waste. Disposal in household waste is expressly prohibited by the Battery Act. As a final consumer, you are legally obliged to return used batteries. Please dispose of waste batteries or batteries at a municipal collection point or drop them off free of charge at the respective point of sale on site. After use, you can return batteries or batteries received from us free of charge or return them to us by post at the address below. In any case, we will refund you the postage for the return of your used battery.

Pb = Battery contains more than 0.004 percent lead by mass

Cd = Battery contains more than 0.002 percent cadmium by mass

Hg = Battery contains more than 0.0005 percent mercury by mass

9. Note on the Electrical and Electronic Equipment Act

Waste equipment containing pollutants is marked with the symbol of a crossed garbage can, similar to the symbol in the figure:

We have to take back waste equipment of the same type of equipment, which essentially performs the same functions as the new device, free of charge when handing over a new electrical or electronic device to an end-user.

We must take back waste equipment which is not in any external dimension greater than 25 centimetres, free of charge in household quantities; the return is not linked to the purchase of an electrical or electronic device from us.

You can return these devices to us free of charge by sending them back to us by post:

If you would like us to take back an old device from you, we kindly ask you to send us an email with your request to info@motomobil.com. After receipt of your email, we will send you information for the return, etc. Of course, you can continue to hand over an old device at one of the municipal collection points, which is also possible free of charge for end users.

The disposal of waste equipment containing pollutants in household waste is expressly prohibited!

Batteries or accumulators must be removed before discharging the devices, if possible. Batteries and accumulators shall be removed in such a way that they are not damaged and can be identified after removal. Waste equipment often contains sensitive personal data. This applies in particular to information and telecommunications equipment such as computers and smartphones. Please note in your own interest that each end-user is responsible for the deletion of the data on the waste equipment to be disposed of.

1. How does the online contract with us work?

If you have found a product in our webshop that suits your needs, click on the button "Add to cart". The item is then placed in your shopping cart and the contents of the shopping cart are displayed in an overview.

Once you have placed products in the shopping cart, the products in the shopping cart are displayed at the left side under the heading "Shopping basket".

By pressing the "To checkout" button, you can initiate the ordering process with respect to the items in the shopping cart.

After pressing the "Checkout" button, a page opens where you can enter your name, address and contact details. You can also specify a separate delivery address.

After entering your song address, please click on the "next" button to specify the payment method you want.

After selecting the payment method you want, you will need to press the "next" button again to continue the ordering process.

You will now be taken to an overview, which will show you the details of your order.

You will also be asked here if you would like to store your data for future orders by registering with us. To do this, enter a user name and password in the appropriate field provided for this purpose. After successful registration, you can log in to our website at any time with your username and password and then carry out orders with your deposited future orders in a simplified manner.

Read the cancellation policy and the general terms and conditions carefully and hereafter confirm the input fields "I confirm the terms and conditions and the correctness of the data provided"" and "I have read and accept the cancellation policy."  by setting a check mark on the corresponding input field. You can only continue the order if you confirm that you have taken note of the right of withdrawal and accept the validity of the General Terms and Conditions.

Please check all information carefully. You can edit the data entered during the ordering process using the "Back" function of your internet browser.

If all information is correct, click on "Order subject to payment" to complete the entire ordering process.

We will immediately confirm receipt of your order by email.

2. Storage of the contract text and access for the customer

We store your order data and send it to you in the confirmation of access by email. You will receive our General Terms and Conditions by email at the latest after the conclusion of the contract.

3. Input error

You can correct your entries at any time during the ordering process by making the corresponding change in the respective field. You can change the number of items you want by changing the number in the Quantity field in the shopping cart and clicking Accept Quantities.

By closing the internet browser, you can cancel the entire ordering process at any time.

4. Contract language

You have the opportunity to conclude contracts with us in German.
